Sharing Policy

By using the sharing features within the DMXDesktop application ("Application"), you agree to the following terms:

1. No Warranties

DMXDesktop offers no warranties, express or implied, regarding any content shared through the Application, including but not limited to Fixture Profiles, Effect Cues, or any other features or functionalities that may be enabled for sharing in the future ("Content"). All Content is provided "as-is," and DMXDesktop makes no guarantees about the accuracy, functionality, or compatibility of any shared Content. You use, modify, and share Content at your own risk.

2. No Intellectual Property or Licensing

By sharing Content through DMXDesktop, you acknowledge that no intellectual property rights or licenses of any kind are granted, implied, or transferred. Any Content you share, modify, or create is provided to the DMXDesktop community without restriction, and you relinquish any claim to ownership, intellectual property rights, or other legal rights over the shared or derivative works. Others may freely use, modify, and redistribute your shared Content without compensation or attribution.

3. Relinquishment of Rights

By sharing any Content, including derivative works, you expressly waive all claims of ownership, copyright, or other intellectual property rights over that Content. Once Content is shared, you forfeit any rights to exclusivity, control, or compensation regarding its use by others.

4. Content Review and Approval

All shared profiles and other Content will be reviewed before being approved for distribution. Approval will normally take up to 24 hours, but could be considerably longer and Content will not appear in the Application until this process is completed. DMXDesktop reserves the right to reject or remove any Content at its discretion.

5. Privacy and Content Guidelines

You must not include any personally identifiable information (PII) in your shared profiles or other Content. Additionally, profanity, offensive language, or any content that may be deemed inappropriate is strictly prohibited. These rules are in place to protect your privacy and the privacy of others. Non-compliance will result in the removal of the shared Content, and you may be denied from sharing in the future.

6. Responsibility for Content

You are solely responsible for ensuring that any Content you share complies with applicable laws, including intellectual property laws. DMXDesktop is not liable for any infringements, misuse, or disputes arising from Content shared by users.

7. Non-Acceptance

If you do not agree to these terms, you must refrain from sharing any Content through DMXDesktop. Sharing any Content despite non-acceptance of these terms will be considered your acceptance of these terms by default.

8. Changes to Terms

In compliance with EU GDPR regulations, DMXDesktop will notify you in advance of any changes to these terms and conditions. You will be given reasonable time (at least 30 days) to review and accept the changes, or opt out of sharing Content if you do not agree with the updated terms. Continued use of the sharing features after this period will be deemed as your acceptance of the new terms. If you choose to opt out, you may no longer share Content but may continue to use other functionalities of the Application.

9. Record of Consent

DMXDesktop will keep a record of your acceptance of these terms, including the version of the terms, your IP Address and the date of your consent. This record is stored to ensure compliance with GDPR and other applicable laws. You may request a copy of your consent record at any time by contacting our support team.
